Rather Puzzling News Item

I just heard on the news that some guy in North Carolina has been arrested because he said he'd like to kill Barack Obama. Someone overheard him saying it and called the police. He is going to have a psychiatric evaluation before the authorities decide what to do with him.
It doesn't puzzle me at all that someone dislikes Mr. Obama. I don't much like him, either. That's not to say I would want to see him assassinated. Not elected, yes! Killed, no. That being said, shouldn't threatening to maim him be an arrestable offense if threatening to kill him is? Was Jesse Jackson arrested?
And shouldn't Alec Baldwin have been arrested for wishing Vice President Dick Cheney dead? How about the movie that gave details of assassinating President Bush? Shouldn't someone have been arrested and "evaluated" for that?
The puzzling part for me is that if someone threatens to kill an average citizen (someone who knows the person personally, has a weapon, has a criminal history, and knows where the intended victim lives) the police will tell you there's nothing they can do until an attack actually happens. Threatening isn't against the law.
Is Barack Obama is such a "class by himself" that it's a crime to threaten him? But why wasn't Jesse Jackson arrested?
Such a double standard is very puzzling... and very disturbing...
