E.W.I.??

Here's something I've never heard of before, but it doesn't surprise me very much. Emailing While Intoxicated. Apparently the latest illegal endeavor that folks can indulge in is to text or email people if they've had too much to drink. Honestly, what will they think of next?
Texting or emailing isn't as likely to wake the recipient up as the ringing of a telephone. Most people turn their cell phones off at night or when they're too busy to answer them, don't they? Everyone I know does... And when was the last time an email woke you from a sound sleep? You don't have to answer the messages and you can block offensive emails.
E.W.I. sounds to me like a new lib/dem way to control people. Sort of like the "second-hand" smoke silliness of suing your neighbor (half a mile away) for lighting a legal cigarette in their own home with the windows closed.
So, I can't help but wonder how a drunken emailer or texter can be proven guilty? Does the recipient of a suspicious message call the police immediately and have them dispatched to the location of the "offender" to give a forced breath test? Or maybe a blood test? What if the "accused" lives in a different state? Or country? Does it automatically become a case for the FBI or Interpol? Imagine the hundreds of Special Agents it would require to prove that someone was, indeed, intoxicated while using their email or text capabilities! Would it be (as with drunk driving) mandatory to prove that the offender was drunk (or stoned, or whatever) at the time the email or text was sent? Or would the charge be enough to cause an arrest?
Shall we load the courts with more frivolous lawsuits and criminal charges so crooked lawyers can get rich? Maybe the EWI charge would be a cool way to get even with someone you don't like, huh? How about the counter suits? And false arrests? And harassment? In just a short time, there'll probably be EWI offenders who require prison time to pay for their crimes. Let's raise the taxes a little more to pay for new penitentiaries to contain them!
Yep, creating a new crime is much easier than finding ways to prosecute the real criminals, right? The internet is a wonderful invention, folks! But criminals and villains have wormed their way into it. Like kiddie porn, for example. Or sexual predators who go after teenagers? How about the woman who drove a teenager to suicide? How about terrorists using it to plan attacks and recruit new monsters to kill more innocents? Maybe we should concentrate on stopping the real crimes before inventing new ones designed to confuse the issues, raise taxes, and take away more rights from the individual citizens. Ya think?
